Section 17 Child in Need: Legal Framework and Practice.
This will provide an overview of the legal framework governing Child in Need (CIN) work under Section 17 of the Children Act 1989. Participants will consider the definition of a CIN, the local authority’s statutory duties and the legal framework for assessing and providing services to children and families and how these duties translate into practice. The workshop will explore parental responsibility, consent and the child’s wishes and feelings, including the legal considerations when working with children and parents. Drawing on the principles of Working Together to Safeguard Children, the session will consider the importance of effective multi-agency working in the assessment, planning and review of support. Participants will explore the local authority’s duties to assess children in need and the possible outcomes of an assessment, including the thresholds for Section 17 Child in Need and Section 47 child protection intervention. The session will also consider the local authority’s duties to safeguard and promote children’s welfare, including supporting children to remain within their families wherever safe and appropriate. It will introduce Sections 20 and 31 of the Children Act 1989 and how these differ from Section 17 support.
