    Eligibility: This course is open to anyone working in education, health or social care.

    This one-day programme aims to develop the knowledge, skills, competence and confidence of practitioners who regularly need to consider capacity/complete capacity assessments and managers who supervise staff who apply the MCA in practice. The target audience includes managers and practitioners who have a foundational knowledge of the MCA and are either new to undertaking mental capacity assessments or who have not undertaken MCA training recently and require more than a refresher.

    Learning outcomes

    As a result of this course, you will have knowledge and skills in the following areas:

    • Applying the statutory principles of the Mental Capacity Act (2005) in practice, including their relevance to 16–17-year-olds, the role of parents/carers, and the interface with the Children Act 1989 and Children Act 2004.
    • Understanding the influence of key case law on MCA practice, particularly in relation to the Human Rights Act 1998 (Articles 5, 8 and 14) and the United Nations Convention on the Rights of the Child.
    • Identifying decisions and relevant information, using this to effectively support decision-making (Principle 2) and when assessing capacity as required..
    • Distinguishing between unwise decisions and lack of capacity, avoiding the ‘protective imperative’ while balancing MCA, safeguarding, and children’s rights responsibilities.
    • Making and recording defensible decisions about whether a mental capacity assessment is required or not.
    • Completing and recording legally robust mental capacity assessments, applying the four-stage functional test.
    • Recognising the impact of executive functioning difficulties and fluctuating capacity, and adapting assessment practice accordingly
    • Applying the causative nexus test, evidencing the link between an inability to make a specific decision and an impairment or disturbance.
    • Identifying the process of making a ‘best interests’ decision under the Mental Capacity Act.

    Charges

    The charge for the course is £115, however you may be entitled to a reduced rate, or fully funded place depending on what organisation you work for.
